Stewart case is a case in point. Martha Stewart was being investigated for
securities fraud. One day, federal agents (detectives) arrived at her
door and requested she answer a few questions. She agreed without asking
to speak with a lawyer. Since she was not in "custody", the
agents were not required to read her her "Miranda Warnings".
The prosecution charged Martha with Securities fraud and with lying to federal
officers (obstruction of justice). A jury found Martha Stewart not guilty
on the charge of securities fraud, yet the jury found her guilty of obstruction
of justice for statements she made to the federal investigators during
questioning. An experienced criminal defense lawyer would have insisted
that Martha Stewart not speak to anyone. Had Martha Stewart had the presence of mind to simply request a lawyer before any
questioning, she would not have spent any time in prison and would not be
labeled, for life, as a convicted felon. Had she simply called an attorney, she probably would not have been charged at all.
